SK Police Log: October 3, 2012

Unless otherwise noted, information about the following incidents was supplied by the South Kingstown Police Department. An arrest does not indicate a conviction.

Connecticut Woman Charged With Drunken Driving

Marissa E. Digioia, 21, of 52 Valley Break South Road, Branford, CT, was arrested at about 12:21 a.m. on Oct. 3 and charged with drunken driving.

According to police, an officer monitoring traffic on Matunuck Beach Road near the Vanilla Bean saw a car drifting and swerving, and then traveling in the breakdown lane on Route 1. A traffic stop was made near Jerry Brown Farm Road.

Police said that when asked for her license, registration and insurance info, Digioia handed them her license, registration and her college course schedule. She then told them, “I don’t know why you pulled me over, I wasn’t even speeding.”

According to police, Digioia smelled of alcohol, and submitted to field sobriety tests, which she failed. She was arrested at this point.

Police noted that Digioia consented to a chemical test at headquarters, but multiple attempts were needed between 1:44 a.m. and 2:29 a.m. because of insufficient breath samples. According to police, two valid samples revealed blood alcohol levels of .155 and .161.

Digioia was processed and then released at about 3:20 a.m.

West Warwick Man Charged With Domestic Disorderly Conduct

David E. Hazard, 36, of 14 Sisson St., West Warwick, was arrested at about 4:06 a.m. on Oct. 3 and charged with domestic disorderly conduct.

According to police, on the night of Oct. 2, Hazard made threatening phone calls to a 36-year-old South Carolina woman. Police confirmed the calls and issued a bulletin for his arrest.

South Kingstown police said that Westerly police arrested him later that night. He was picked up from Westerly police, processed and then held for arraignment at Fourth Division District Court.

South Kingstown Man Charged With Disorderly Conduct

Neil W. Yorty, 26, of 3556 Commodore Perry Highway, South Kingstown, was arrested at about 9 p.m. on Oct. 3 and charged with disorderly conduct.

According to police, they received a report from a person at the Cox Communications Retail Store in the South County Commons about Yorty. The witness told police that Yorty had been upset in the store, “caused a scene” and on his way to his car, thrown a pumpkin.

Another employee told police that Yorty was upset with the service he was getting, and told them, “The equipment is ****ing ******. Cox is a fitting name for you.” The employee said Yorty refused to quiet down, and as he and a family member walked to their car, he threw a pumpkin outside of the store.

Police said they were able to interview Yorty later that day, and said he denied throwing the pumpkin, but admitted to arguing with the store clerks. He was arrested and charged with disorderly conduct, and also issued a no-trespass warning for the store.

South Kingstown Man Charged With Possession of Marijuana

Kyle A. Bessette, 23, of 9 Arrow Head Trail, South Kingstown, was arrested at about 12:31 a.m. on Oct. 3 and charged with possession of marijuana. He was also cited for an expired driver’s license.

According to police, an officer monitoring car on Old Tower Hill Road near Xtra Mart noted a silver Toyota Solara with an illegal tint on the windows. A traffic stop was made at Xtra Mart.

Police said that when speaking to the driver – Bessette – the smell of marijuana was coming from inside the car. When asked if he had any marijuana in the car, Bessette allegedly provided police with several small baggie.

Bessette was arrested, processed and then released at about 3:01 a.m. He was also cited for driving with an expired license after a background check.

South Kingstown Man Arrested for Warrant

Neil Exumn Britto, 42, of 1358 Kingstown Road, South Kingstown, was arrested at about 8:34 a.m. on Oct. 3. Police said a Superior Court warrant was out for Britto’s arrest.

According to police, a man told an officer parked near the Welcome Mart that Britto was inside, and that he had a warrant out for his arrest. Police confirmed the warrant with a dispatcher, and then waited for Britto to come out.

Police said Britto came out a short time later, and he was arrested without incident. He was then transported to Fourth Division District Court for arraignment.

In June, Britto was arrested and charged with stealing a van. That case is still pending.
