SK Man Charged With DWI; BAC Allegedly .326

South Kingstown police said Dustin D. Fildes, 34, crashed his car into a stone wall and had a blood alcohol level of .326.

Dustin D. Fildes, 34, of 129 Pearls Way, South Kingstown, was arrested at about 5 p.m. on Feb. 17 and charged with drunken driving with a blood alcohol level greater than 0.15.

According to police, they received a 911 call of a car crashing into a stone wall at the intersection of Mooresfield Road and Rose Hill Road.

Police said Fildes was behind the wheel of the car, which had no other occupants. Police said Fildes smelled strongly of alcohol, and told police he had had two beers and a shot of whiskey earlier.

According to police, Fildes showed severe signs of impairment during field sobriety tests, which he couldn’t complete. Police said Fildes was arrested as a result.

Police said Fildes was offered the opportunity to call a lawyer, noting that he had a Rhode Island Public Defender business card on his person when he was arrested. Police said Fildes refused, and consented to chemical breath tests.

According to police, Fildes blood alcohol level tested at .326 at 5:46 p.m. and .321 at 5:48 p.m. Police also noted the Fildes was arrested by Narragansett police on Feb. 4 and charged with drunken driving.

Police said that based on Fildes pending drunken driving charge, he was held overnight for arraignment in Fourth Division District Court on the morning of Feb. 18.

According to online records, Fildes was denied bail and transferred to the ACI after his hearing on Feb. 18. He remains at the ACI as of Feb. 21, with a status conference for both drunken driving cases at Fourth Division District Court on Feb. 27.
